Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you (“Candidate,” “you,” or “your”) and Neurolus, LLC, a North Carolina limited liability company (“Neurolus,” “we,” or “our”). These Terms govern your purchase, registration, access, and use of our website, examinations, and related services (collectively, the “Services”). By using the Services, you agree to these Terms and our Privacy Policy, which is incorporated by reference.
If you do not agree to these Terms, you may not use the Services.
I. Scope of Services
A. Supervised Admissions Examinations
Neurolus develops and administers standardized, supervised admissions examinations for adults. Candidates are solely responsible for securing an independent third-party proctoring facility (“Proctoring Center”), which may include a public library, community college, university, notary, or professional testing center. Neurolus does not provide proctors and does not guarantee the availability, scheduling, pricing, or suitability of any Proctoring Center.
Approval of a Proctoring Center by Neurolus does not create an agency, employment, partnership, or contractual relationship between Neurolus and the Proctoring Center.
B. Scores and Third-Party Recognition
Neurolus scores examinations and releases results to the Candidate and, where explicitly authorized, to approved third parties (for example, high-I.Q. societies). Neurolus does not guarantee acceptance or recognition of any score by any third party.
C. Research
Participation contributes to ongoing psychometric, normative, and validation research. Neurolus may use and publish performance data only in anonymized and aggregated form.
D. Recreational Products
Neurolus may offer recreational puzzles or tests intended solely for entertainment. These products are not validated assessments and may not be used as admissions, psychological, or diagnostic instruments.
II. Eligibility and Access
A. Age, Language, and Identity Verification
Candidates must be legal adults aged eighteen (18) years or older and possess sufficient English proficiency to understand examination instructions and content. The proctor must verify age and identity using valid government-issued photo identification. Failure to present proper identification results in dismissal and score invalidation.
B. Accessibility
Accessibility requests are reviewed on a case-by-case basis. Accommodations may be approved when they do not compromise psychometric validity, do not confer unfair advantage, and can be implemented consistently across approved Proctoring Centers.
III. Payments, Scheduling, Refunds, and Rescheduling
A. Before You Purchase
Before purchasing an examination, you are solely responsible for confirming that you meet Neurolus’s eligibility requirements (including the 18+ requirement) and that you can access an appropriate Proctoring Center that meets Neurolus’s published proctoring requirements.
Payment does not guarantee eligibility or approval of a proposed Proctoring Center.
B. Refunds
Fees are generally non-refundable. Neurolus will provide a refund where required by applicable consumer protection laws, including where: (i) Neurolus does not deliver the purchased service, (ii) the examination cannot be administered due to an error caused by Neurolus, or (iii) a mandatory legal right to a refund applies in your jurisdiction.
These exceptions do not apply when a Candidate violates exam security rules or fails to appear for a scheduled examination.
C. Proctor Errors or Material Loss
Proctoring Centers act as independent third parties. Neurolus is not responsible for scheduling, staff conduct, or operational errors made by a Proctoring Center. If examination materials are lost, damaged, or improperly transmitted due to actions outside Neurolus’s control, Neurolus is not obligated to provide a replacement examination, refund, or accommodation except where required by applicable law.
D. Proctor Selection and Scheduling
After purchasing an examination, you will receive access to a secure web portal used to complete registration, propose a Proctoring Center, and set an examination date and time. Scheduling is subject to Neurolus approval of the selected Proctoring Center.
Candidates are responsible for securing an appropriate Proctoring Center in accordance with Neurolus’s published proctoring requirements and instructions, as described in the Proctoring Information page and in communications provided through the Candidate Portal. These materials are informational and do not limit Neurolus’s discretion to approve or reject a proposed proctor.
Rejection of a proposed Proctoring Center does not entitle the Candidate to a refund, reimbursement, or compensation for any fees or arrangements made with that Proctoring Center.
E. Rescheduling and Materials Transmission
You may reschedule an approved examination through the Candidate Portal at no charge until examination materials are transmitted to the approved Proctoring Center. Materials are typically sent approximately twenty-four (24) hours prior to the scheduled start time. Once materials are transmitted, rescheduling is no longer permitted.
Failure to attend after materials are transmitted is treated as a no-show. In the event of a no-show: (i) the examination fee is forfeited, and (ii) a new sitting requires the purchase of an additional examination. Repeated no-shows may result in refusal of future service and may result in permanent termination of access to the Services.
This policy applies equally to paid sittings and sittings for which a fee was waived.
F. Extraordinary Circumstances
In rare and exceptional circumstances (for example, a verified natural disaster or documented life-threatening emergency), Neurolus may, at its sole discretion, permit an accommodation or reattempt. Any such decision is final and does not create a general policy or entitlement.
G. Proctoring Fees and Third-Party Costs
The examination fee paid to Neurolus covers only development, administration, scoring, and processing of the examination. It does not include any fees, charges, or expenses imposed by a Proctoring Center or other third party engaged by the Candidate. All such costs are the Candidate’s sole responsibility, and Neurolus does not reimburse or credit proctoring-related expenses.
H. Glia Society Fee Waiver
Neurolus may, at its sole discretion, waive the standard examination fee for a single examination sitting for Candidates who are verified members in good standing of the Glia Society at the time of request. This waiver, if granted, applies to one (1) examination sitting only and does not create an ongoing entitlement to free or discounted services.
Neurolus reserves the right, in its sole discretion, to deny or revoke a fee waiver for any reason, including but not limited to prior misconduct, prior no-shows, suspected abuse of the waiver policy, or concerns relating to examination security or integrity.
If a fee waiver is granted and the Candidate fails to appear for the scheduled examination after materials have been transmitted to the approved Proctoring Center, the sitting is treated as a no-show. In such cases, the waived fee is deemed forfeited, and any subsequent examination sitting requires payment of the standard examination fee, notwithstanding Glia Society membership.
A fee waiver may not be transferred, reused, or reinstated following a no-show, cancellation after materials transmission, or termination of access to the Services.
IV. Candidate Responsibilities and Exam Integrity
A. Truthful Information
You represent that information you provide is accurate and consistent with your government-issued identification. Providing false or misleading information is a material breach of these Terms.
B. Confidentiality and Nondisclosure
Examination content is confidential. You must not copy, record, reproduce, disclose, or attempt to reconstruct examination materials. These obligations apply indefinitely and survive completion of the examination.
C. Misconduct; Score Invalidation
Neurolus may invalidate a sitting or revoke a score if exam rules are violated, procedures are compromised, or statistical validity cannot be assured.
D. Refusal of Service
Neurolus reserves the right, at its sole discretion, to refuse service to any Candidate, to decline to administer an examination, or to terminate access to the Services, including before or after payment, where Neurolus reasonably determines that doing so is necessary to protect examination security, intellectual property, fairness, operational integrity, or legal compliance.
If Neurolus refuses service prior to administration of an examination and the Candidate has paid an examination fee, Neurolus will refund the examination fee, except where refusal is based on the Candidate’s misconduct, violation of these Terms, or abuse of the Services.
Refusal of service under this section does not create any obligation to disclose investigative methods, security criteria, or internal risk assessments.
V. Disclaimers
Neurolus examinations are admissions instruments and are not clinical or psychological diagnoses. The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Neurolus disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
VI. Intellectual Property
All examination materials, proctor instructions, and website content are the exclusive intellectual property of Neurolus or its licensors and are provided only for their intended use.
Any unauthorized copying, reproduction (including recreation from memory), or sharing (e.g., photographing, scanning, posting, distributing, or selling) is prohibited and will result in termination of access and a permanent ban. Neurolus may pursue legal remedies, including injunctive relief and damages.
VII. Limitation of Liability
To the maximum extent permitted by law, Neurolus’s total liability for any claim arising out of or relating to the Services shall not exceed the amount you paid to Neurolus for the specific Service(s) giving rise to the claim. To the maximum extent permitted by law, Neurolus will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, or business opportunity.
VIII. Indemnification
You agree to indemnify and hold harmless Neurolus and its officers, directors, employees, and contractors from any third-party claim arising from your violation of these Terms, misuse of the Services, or infringement of any intellectual property or other right.
IX. Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, subject to non-waivable consumer protections. Nothing in these Terms limits any non-waivable rights granted to Candidates under applicable consumer protection or data protection laws in their jurisdiction.
Arbitration (U.S. Residents)
If you are a U.S. resident, you and Neurolus agree to resolve most disputes through binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. Arbitration will be conducted by a neutral arbitrator under the rules of the American Arbitration Association (AAA) or another established provider selected by Neurolus, and will take place in Wayne County, North Carolina (or remotely if permitted), unless the parties agree otherwise.
Class action waiver. To the extent permitted by law, disputes must be brought on an individual basis and not as a plaintiff or class member in any purported class, collective, or representative action.
Opt-out. You may opt out of this arbitration agreement by sending an e-mail to contact@neurolus.com within thirty (30) days of your first purchase, stating your name and your intent to opt out.
X. Amendments
Neurolus may amend these Terms at any time. Continued use after the Effective Date constitutes acceptance of the revised Terms.
